Prior to becoming COO, Dustin served as Betterment's Chief Technology Officer, as well as the VP of Engineering. Dustin received his Bachelor’s degree in Biomedical Engineering at Case Western Reserve University, as well as his Master’s degree in Biomedical Imaging & Computing.

Starting your own business and picking the right niche in no time

More than a few commentators have exclaimed that “Software Patents Are Dead!” Headlines like these grab the attention of technologists and business leaders, but they are dangerously misleading. Far from being dead, patent protection for software-driven innovations remains viable and important. It’s true that some types of software-related patents, especially in the business method area, have received intense scrutiny from courts and the U.S. Patent & Trademark Office following the passage of the America Invents Act in 2011 and the Supreme Court’s 2014 decision in Alice v CLS Bank. But the crackdown on business method patents has not resulted in general ban on protection of computer-implemented inventions.  Regardless of the specifics of the software, companies that forgo patent protection can face a perilous road, as copyright and trade secret protection can be insufficient means of stopping others from developing competing products and services. That said, both jurists and patent lawyers have decried the unpredictable and fast-changing state of software patent law, even going so far as describing it as an “analytical dumpster fire.”

James R. Klaiber is Counsel in the Intellectual Property Group of Hughes Hubbard & Reed.  His practice is focused on patent litigation, prosecution, and transactions, including telecommunication, data protection, medical device, automotive, semiconductor, and packaging technologies.  He is a former AT&T Bell Laboratories Member of Technical Staff, where his work included research and development of high speed undersea cable systems.

He has mechanical engineering degrees from MIT, the University of California at Berkeley, and the University of Michigan, and his law degree is from Fordham University Law School.  Jim is the former Chair of the ABCNY Committee on Patents, and is a board member and former Chair of the MIT Enterprise Forum of New York City.

In these positions, he has been responsible for developing, coordinating and executing all aspects of patent protection strategies among global teams of business and technology hubs. In addition, he has developed objectives and procedures for identifying and protecting high value technology assets, and organized and led teams of technology leaders, who assisted in coordinating enterprise-wide protection efforts. David also managed patent procurement efforts by in-house and outside counsel.

Bruce S. Weintraub is Senior Corporate Counsel in the Legal Division at Pfizer Inc in New York, NY.  He is a Core Negotiator for the Global IP Transactions Team at Pfizer Inc. This Team supports Worldwide Business Development, Worldwide Research & Development, Global Supply, Digital Innovation and Strategic Alliances at Pfizer Inc. Prior to this position, Mr. Weintraub managed licensing, research and development collaboration agreements, mergers and acquisitions and due diligence for the Pfizer Animal Health division. He graduated from Benjamin N. Cardozo School of Law and is admitted to practice in New York. Mr. Weintraub is a regular speaker and commentator at business seminars and conferences.

Daniel O'Sullivan

Dan is a technology startup Founder and CEO. He has several patents on innovations in speech technology, software, and telecommunications. Dan has an Electrical Engineering degree from the Dublin Institute of Technology in Ireland, and a Masters in Computer Science from NYU, where also taught Computer Science. Dan is a former AT&T Bell Laboratories Member of Technical Staff, where his work included the research and development of high speed digital switching networks, communication protocols, and microchip coding. He is currently developing software for cloud based speech interaction technology for use in phone, IoT, and the Intelligent Voice Assistant markets. Dan is also the current Programming Chair and a board member at the MIT Enterprise Forum NYC.

Catriona Collins

Cate is an attorney and legal knowledge manager working for Lexis Practice Advisor in New York where she develops practical guidance for patent practitioners. She previously worked as an intellectual property litigator, most recently at the New York law firm of Cowan Liebowitz & Latman, P.C., handling patent litigation in a range of technologies, including software, pharmaceuticals and medical devices. As a member of the adjunct faculty at New York University, she has taught courses in patent and trade secrets law and international intellectual property law. She holds law degrees from Trinity College Dublin and the University of Cambridge.

James M. Kelly

Therap is currently used by 17 states for their I/DD systems, and users create 35 million new health records per month. The Therap Services electronic documentation solution includes a certified EHR, HIPAA compliant Medicaid and private billing, service documentation, as well as secure communication and data sharing between all stakeholders including families and self-advocates. Jim is a named co-inventor of many of Therap’s U.S. patents and pending patent applications. Jim earned a Bachelor Degree in Psychology from Northern Illinois University and a Master’s Degree in Corrections Counseling from Chicago State University.
